Freight Terms & Conditions

Effective Date: 7/1/25

These terms govern all transportation services arranged by Coast to Coast Transport, a dba of C&C Logistics Brokerage, Inc. (“Broker,” “we,” or “us”). By tendering freight, the customer (“Shipper” or “Customer”) agrees to the following terms:

Broker Role and Authority

Coast to Coast Logistics is a licensed freight broker (FMCSA MC-1069020) and does not operate as a motor carrier. We arrange transportation through third-party motor carriers who maintain their own operating authority, insurance, and control of equipment and drivers.

Rate Quotes and Adjustments

All rate quotes are based on the information provided at the time of booking and are subject to change based on actual shipment details, including:

  • Dimensions, weight, freight class
  • Packaging type and handling requirements
  • Accessorial services requested or required
  • Final carrier charges and applicable fuel surcharges

Inaccurate or incomplete shipment information will result in billing adjustments.

Shipment Liability and Claims

Coast to Coast Logistics is not liable for cargo loss or damage.
All claims must be filed directly with the delivering carrier within nine (9) months of the delivery date or the expected delivery date.
To assist with claim coordination, shippers must notify us in writing within 120 days of delivery to allow for proper documentation and communication with the carrier.

We may assist with claim preparation but do not assume responsibility for resolution or reimbursement.

Insurance Coverage

Standard carrier liability applies based on carrier tariffs and governing regulations.
Additional cargo insurance must be requested in writing and confirmed prior to pick-up.
Verbal requests or assumptions of coverage are not binding.

Transit Times and Delays

All transit times are estimates only. Delivery schedules are subject to change due to weather, traffic, carrier issues, and other factors beyond our control.
We are not liable for penalties, lost profits, or consequential damages arising from delayed deliveries.

Payment Terms

Unless otherwise agreed in writing:

  • Invoices are due Net 30 days from the invoice date.
  • Late payments are subject to a 1.5% monthly finance charge (18% annual rate).
  • Disputes must be submitted in writing within 5 business days of invoice issuance.

Customers agree to pay all reasonable costs of collection, including attorneys’ fees, court costs, and collection agency fees incurred in recovering past-due amounts.

Cancellations, Detention & Accessorial Charges

The following accessorials and penalties may apply, including but not limited to:

  • TONU (Truck Ordered, Not Used) – if shipment is canceled after dispatch
  • Layover Fees – if the carrier is held overnight due to loading/unloading delays
  • Detention – after standard free time (typically 1–2 hours)
  • Redelivery or Reconsignment – if shipment is refused or address is changed mid-transit
  • Storage – for delayed pickups or deliveries

Accessorial charges will be invoiced based on actual carrier charges.

Governing Law and Venue

These terms are governed by the laws of the State of California, and any disputes shall be resolved in the courts of San Diego County, CA, unless otherwise agreed in writing.

Acceptance of Terms

By tendering freight to Coast to Coast Transport, the Customer acknowledges and agrees to these Freight Terms & Conditions.
Signed agreements or formal rate contracts shall take precedence where applicable.
